RABINOWITZ, Justice. In September 1965, appellant was a passenger in a vehicle which was then owned and operated by Edward Krivak. Appellant and
Krivak were traveling on the Chena Hot Springs Road which at the time in question was under various stages of construction.
At approximately Mile 50 on the Chena Hot Springs Road, in the area of an unnamed stream, Krivak lost control of his car which
traveled off the road and crashed.
